The plaintiff, age 37, had a painful bunion on her left foot. She consulted with a podiatrist who recommended an
ostectomy. The plaintiff waited approximately one year, then consulted with the defendant, a board certified
orthopedic surgeon. The defendant recommended a McBride bunionectomy which is a soft tissue procedure.
The plaintiff agreed to undergo the surgery, but the bunion recurred.
