Facts

The plaintiff visited the defendant, an otolaryngologist, because of an injury she sustained to her nose. The
defendantÆs treatment plan for the plaintiff was to operate for a deviated septum. While he initially examined
the plaintiff, he mentioned that he could fix what he called her "turkey neck," loose skin in her neck area, with
a simple surgery and that she would look a lot better.
After considerable discussion, the plaintiff agreed to the additional surgery on her neck. The neck surgery left
the plaintiff with severe scarring that subsequently had to be treated with laser surgery, but which would never
be fully healed. The plaintiff suffered embarrassment, humiliation and severe emotional distress as a result of
the negligence of the defendant.

Settlement Discussions

The plaintiff demanded $50,000. The defendant made no offer.

Other Information

The jury awarded $132,500 in damages. The case subsequently settled for $130,000.
