Facts

The plaintiff contended that he was mistakenly arrested for suspected shoplifting at the defendantÆs store. The
plaintiff brought an action against the defendant owner and operator of the store and five employees. The
plaintiff, a middle-aged African-American male, claimed the arrest was false and racially motivated. He
claimed that during the course of the arrest, he was assaulted, battered and slandered and the length and
manner of the arrest was unreasonable.
The defendants contended that they had probable cause to stop and detain the plaintiff for suspected
shoplifting. The defendants contended the manner and the length of the arrest was reasonable and their actions
were privileged. The defendants disputed the nature and extent of the plaintiffÆs claimed injuries.
