Facts

On Jan. 28, 1999, the plaintiff, a 51-year-old unemployed machinist, disabled from an 18-year history of multiple
injuries to his neck, back and knee, was using crutches and bilateral knee braces as he walked down the
second floor hallway of his apartment building owned and managed by the defendants.
As the plaintiff approached the staircase, the plaintiff fell forward, collapsed and tumbled down the flight of
the steps to the bottom.

Settlement Discussions

The plaintiff demanded $25,000. The defendant made no offer.
