Facts
The plaintiff a 37-year-old unemployed female bookkeeper, was a tenant in a duplex owned by
the defendant who also resided on the premises. On July 21, 1999, the defendant went twice to
the plaintiffÆs unit to ask her husband and the husbandÆs brother to lower their music since other
tenants complained. The defendant made a second visit to the plaintiffÆs unit 30 minutes later,
when a confrontation erupted between the defendant, the plaintiff and the plaintiffÆs brother-in-
law, during which the defendant was repeatedly punched in the face and the plaintiff knocked to
the floor.
Injuries
Two fractured ribs, 3 mm herniated disc and cord impingement at 5 levels, neck and back sprain and aggravation of prior workers comp back injury seven months earlier.
