Facts

The plaintiff, a 21-year-old woman went to defendant clinic for a minor surgical procedure under general
anesthesia. The plaintiff suffered a respiratory arrest shortly after the procedure. The plaintiff contended the
defendant obstetrician, nurse anesthetist and nurses attempted resuscitation efforts including defibrillation but
were unsuccessful. The plaintiff subsequently recovered but still suffers from mental and physical deficits as a
result of lack of oxygen.

Settlement Discussions

During settlement discussions, there was an offer of $2 million and a demand for $4 million. The resulting settlement was for $3 million cash.

Injuries

Brain damage due to lack of oxygen following cardiopulmonary arrest.
