Facts

The decedent, a 29-year-old male, died of smoke inhalation on Feb. 14, 2000, when a small smoldering fire
broke out in his bedroom during the night. He was single and had no financial dependents. His mother
instituted this suit against the defendant landlord who lived on the premises as resident manager/owner.
The background to the case is that immediately prior to the night in question, the
decedent had returned to his apartment after being out for nearly 36 hours having participated in
Rave party. Soon after returning to his apartment, he went into his bedroom, lit a candle and
then fell asleep. While sleeping, the candle was knocked over by the plaintiff and a small
smoldering fire broke out. At some point, he awakened and tried to escape but was unable to do
so. He died from smoke inhalation.
