Facts

On Dec. 28, 1999, at 7:30 p.m., the plaintiff husband was driving a rented vehicle southbound on
Jamboree Blvd. in Orange. His wife was a passenger in the right front seat. As they entered the
intersection with Main St. on a green light, a BMW driven by the defendant and traveling
westbound on Main St., ran a red light and broadsided the plaintiffs in their rented vehicle.

Settlement Discussions

The plaintiffs settled with the third-party defendant on Feb. 2, 2001 for $15,000 each, being the policy limits. The plaintiffs then proceeded with this uninsured motorist action. The husband settled for $100,000, the limits of his UIM coverage and his wife settled for $85,000. A mediation was held before Troy Roe.

Injuries

The plantiff husband suffered 3-level cervical fusion and ulnar nerve. Transposition for the left ulnar neuropathy - cubital tunnel syndrome.
