Facts

Seven minority factory workers, the plaintiffs, were employees of the defendant company. They had been exposed for many years to racially derogatory epithets and race-hate graffiti from other employees. Their complaints to management were either ignored and/or trivialized. The defendant employer denied that it had failed to take appropriate action against the offending parties.

Settlement Discussions

The plaintiffs agreed to a figure of $3 million proposed by the mediator, but this was rejected by the defendants. On the first day of trial, the parties settled for $3.3 million along with the plaintiffs' resignations.
