Facts

On Dec. 19, 2001, the plaintiff, an on-duty Los Angeles Police Department officer, was working a Homeland Security detail post "9/11" and was operating a checkpoint for traffic authorized to park at the City Hall parking structure. The defendant Los Angeles Unified School District bus driver was returning from a field trip with a busload of middle school children. The bus driver stopped at the checkpoint. The bus driver proceeded forward and struck the side of the plaintiff at 1-5 mph. The plaintiff told the defendant bus driver that he was okay after the impact.

Settlement Discussions

At the first court-ordered mediation, no offer was made. The second mediation before retired Judge Irwin Nebron resulted in the settlement of $382,500, inclusive of $50,000 in satisfaction of the city's lien of $90,000.
