Facts

The claimant, a homeowner, retained the respondent, an interior design firm serving residential and commercial clients to design a sophisticated multimedia home theater and an electronic control system for the entire house. The claimant contended that he suffered damages as a result of the respondent's breach of a contract for the interior design services and negligent performance of work at his home. The claimant also argued that the respondent fraudulently misrepresented his skills and experience and fraudulently induced the claimant to enter into the agreement for his services. The claimant suffered monetary damages due to the respondent's providing him with a defective home theater and lighting control system, both of which were unusable and required replacement. The respondent also designed and/or supplied defective light fixtures, closets and furnishings and the respondent's delay and mismanagement caused the claimant additional damages.
