Facts

Plaintiff Richard Mudge, 62, underwent gallbladder surgery at defendant California Pacific Medical Center in San Francisco. Because the plaintiff was taking cholesterol medication, his liver was regularly monitored. The plaintiff's liver enzyme levels were normal for 20 months prior to the surgery. After the surgery, the enzyme levels were elevated. Blood tests confirmed that plaintiff had contracted hepatitis C.

Settlement Discussions

The plaintiff demanded $150,000. The defendant made no offer.

Injuries

The plaintiff took chemotherapy drugs for 44 weeks and is considered cured of the infection.
