Facts
Deborah McMurray, 57, worked as an administrative officer with the city of Burbank. She took time off work for medical problems involving stress in 1999 and 2000. As a result, she claims she was passed over for promotions, and supervisory duties were taken from her. McMurray sued the city of Burbank, alleging disability discrimination, age discrimination, gender discrimination, retaliation under the Fair Employment and Housing Act and violation of the California Family Rights Act.

The plaintiff claimed loss of earnings and special damages in the amount of $997,000. The defendant claimed there was no lost earnings and negligible specials because of insurance.
