On Nov. 15, 2002, defendant Gage, was operating his automobile on Protero Road in Ventura in the area east of Sherwood Country Club while he was intoxicated. He crossed the center line and hit a pick-up truck occupied by the plaintiffs, Andres Roman, Noe Roman and Miguel Perez. Andres Roman was killed. He had several children, three from his first wife and four from his second. Noe Roman and Miguel Perez sustained significant injuries in the collision.
Settlement Discussions
The parties settled after an 18-hour mediation before Kevin McGivers for $1.5 million. The defendant had $1.3 million in insurance coverage and contributed an additional $200,000 of his own money.
