Facts

The claimant was employed by a company that decided to move to another area of the state, approximately 350 miles away. The defendant employer agreed to pay approximately $20,000 of the plaintiff's moving costs to the plaintiff. Repayment was necessary if the plaintiff left the company within one year of the move. The plaintiff's salary was to be $113,000 annually. Two days after the plaintiff reported to work at the new location, he was laid off. The plaintiff claimed a violation of Labor Code 970. The defendant contended that the lay off was necessary because of economic necessity.

Settlement Discussions

The plaintiff demanded $500,000; the defendant offered $35,000.
