Facts

The plaintiff, age 47, was working as an independent truck driver, picking up a load of K-rails from the defendant and to be taken to a construction site. Six K-rails were to be loaded onto the truck bed. The defendants used L-hooks to load the K-rails onto the truck bed. During loading, an L-hook caught onto one of the K-rails causing it to move. The plaintiff's right leg was crushed between two K-rails. Each K-rail weighed two tons.

Injuries

Initially, the plaintiff suffered a crush injury to his right leg which required surgical intervention. He subsequently developed an infection which led to the amputation of his right leg, above the knee. In addition, he suffered an exacerbation of an earlier back injury for which he had undergone a two level lumbar fusion.
