Facts

On March 10, 2003, at 2 a.m., the plaintiff, a 17-year-old female, purchased two tacos from the defendant's restaurant. Approximately four to six hours later, she became ill with diarrhea, vomiting and fever. The plaintiff received emergency room care and was eventually hospitalized for a three-day course of treatment.

Settlement Discussions

The plaintiff initially demanded $80,000, later reduced to $10,000. The defendant made a statutory offer in the amount of $501.
