Facts

The plaintiff alleged bodily injuries, personal property damages and wage loss as a result of a fire that occurred in a home solely owned, operated and maintained by the defendant. The plaintiff alleged that the fire was caused by the defendant's negligent failure to extinguish lit candles before falling asleep. The defendant alleged that the plaintiff caused the fire and that she left the candles lit knowing that the defendant was already asleep. The defendant further alleged that the plaintiff was negligent in reentering the burning house after exiting and reaching safety and that she thereby caused her own injuries. The plaintiff alleged she reentered the house because of the defendant's requests for help to put out the fire, out of concern for the defendant's safety, to save her dog and to grab her mobile phone to call 911.

Settlement Discussions

The parties attended mediation with Mike Ornstil of JAMS. Ultimately, the case settled outside of mediation for $150,000.
