Plaintiff homeowners association alleged a number of problems stemming from claimed construction defects,
including: roof leakage, mold issues, fence and siding deterioration, and grading problems. Defendants
developer and subcontractors denied any construction defects, and also alleged problems with the applicable
statute of repose and statutes of limitation, and partial lack of standing.
Settlement Discussions
After extensive mediation over a period of approximately one year, the parties settled for $1,100,000 in exchange for a dismissal of all claims.
