Facts

On Monday, July 19, 2004, at 3:50 p.m., the plaintiff, age 37, was walking northbound on Figueroa Street on the westside of the intersection with Diamond Street. A 2000 Ford Mustang owned and operated by the defendant, traveling south on Figueroa Street commenced a right-hand turn onto Diamond Street and struck the plaintiff on her right side causing her to fall violently onto the pavement.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff contended that the defendant violated Vehicle Code Section 22107 which provides: "No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal . . . in the event any other vehicle may be affected by the movement." The plaintiff further alleged that the defendant was working within the course and scope of his employment.

DEFENDANT'S CONTENTIONS:
The defendant disputed the nature and extent of the plaintiff's injuries.
