Facts
777 Plumbing Inc. sued Ignacio Camarillo, John Van Noord, Donna Van Noord, and Christine Gigas, in connection with a plumbing contract work.
Contentions
PLAINTIFF’S CONTENTIONS: The Van Noords and Gigas allegedly owned the subject properties. The property owners hired defendant Camarillo as general contractor, who then hired plaintiff as plumbing contractor. Plaintiff allegedly performed work on the property, but was not paid.
Plaintiff sued and asserted causes of action for breach of contract, common counts, quantum meruit, and unjust enrichment.
DEFENDANTS’ CONTENTIONS: Defendants moved for summary judgment. Defendants alleged that plaintiff failed to carry workers’ compensation insurance during the subject time period. As a result, its contractor’s license was deemed automatically suspended. Consequently, it lacked standing to sue for compensation. Defendant property owners alleged they fully paid plaintiff for the work performed on their property and, as such, they denied any liability.
Result
The court granted summary judgment in favor of the defense.
