Facts

On March 12, 2010, plaintiff was the passenger in a vehicle that was involved in a collision with a vehicle driven by Elmer Mejia. Mejia’s vehicle crossed over the southbound lanes of travel on Sierra Highway near Pearblossom Highway into plaintiff’s northbound lane of travel. Plaintiff sued Mejia, the State of California, and the County of Los Angeles.

Contentions

PLAINTIFF’S CONTENTIONS: Plaintiff contended that the highway was in a dangerous condition because it lacked a median barrier and the addition of k-rails temporarily eliminated one of the northbound lanes of traffic.

Plaintiff asserted causes of action for dangerous condition of public property and negligence.

Result

Plaintiff settled with the County of Los Angeles Department of Public Works for $100,000.
