Edwin Moran sued defendant Janice Share following a traffic collision.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff argued that defendant negligently operated her vehicle when she rear ended plaintiff's vehicle in stop-and-go traffic on the Interstate 5. Plaintiff alleged back and neck injuries as a result of the accident.

DEFENDANT'S CONTENTIONS: Defendant disputed the degree of plaintiff's injuries and causation. Defendant disputed the cost of medical treatment on the grounds that plaintiff did not allege pain at the time of the accident and due to the lapses in time following his medical treatments. Defendant further argued that even if defendant was the cause of the injuries, plaintiff's injuries would have been minor.

Damages

Plaintiff sought recovery in an unspecified amount for medical costs (past and future), and for future pain and suffering.

Plaintiff complained of back and neck injuries requiring chiropractic treatment, epidural injections, and a lumbar discectomy.
