Plaintiff, a then eighth grade student at Orange Center Elementary School District in Fresno County, filed suit against the School District, the County of Fresno, and the Estate of Lance Clement. Clement was the Principal and Superintendent of the School District.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that Clement called her into his office multiple times over the school year and sexually abused her, causing her psychological, emotional, physical and mental injury.
Plaintiff asserted causes of action for sexual battery, negligence, intentional infliction of emotional distress, negligent infliction of emotional distress, false imprisonment, negligence per se, and negligent training of employees.
DEFENDANT'S CONTENTIONS: The School District denied plaintiff’s allegations and asserted various affirmative defenses.
Damages
Plaintiff sought $2 million in damages.
Result
Plaintiff settled with the Estate of Clement and the District for $200,000.
