Facts

On May 7, 2015, police responded to a call in the City of Cerritos regarding a suspicious person. Police encountered Nephi Arreguin, 21, who was inside his parked vehicle. A sheriff’s deputy fatally shot Arreguin. Arreguin’s mother and minor son sued the County of Los Angeles.

Contentions

PLAINTIFFS’ CONTENTIONS: Plaintiffs contended Arreguin was unarmed and made no threatening actions towards the officers. Nonetheless, Deputy Edward Fitzgerald approached Arreguin and shot at him without justification.

DEFENDANT’S CONTENTIONS: The county contended that Fitzgerald shot Arreguin in self-defense after he disobeyed commands and drove at and struck Fitzgerald with his vehicle.

Result

Plaintiffs settled with the county for $1.5 million.
