Bernadette Rutledge filed a complaint against Nancy Berryhill, Acting Commissioner for the denial of her application for disability insurance benefits.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff claimed a disability onset date of March 9, 2003. She applied for benefits in December 2004, but was denied. Plaintiff claimed impairments in her back, chronic knee pain and other impairments. Her applications for benefits were subsequently denied despite the worsening of her condition. In 2013, plaintiff had shooting pains in her back, issues walking and standing. Still, the agency denied her application for benefits, prompting plaintiff to file this instant complaint, challenging the Commissioner's denial. Overall, plaintiff contended that the denial was not supported by the evidence and that the administrative law judge made several factual errors, including failing to consider changed circumstances, in denying her application.
DEFENDANT'S CONTENTIONS: Plaintiff allegedly did not qualify as disabled because she was able to perform some jobs available nationwide.
Result
The court granted Rutledge's motion for summary judgment.
