Betty McDonald sued the County of Los Angeles after undergoing a laparoscopic procedure at a rehabilitation center.

Contentions

PLAINTIFF'S CONTENTIONS: McDonald alleged that she suffered from pain after her initial procedure. McDonald contended that a subsequent procedure revealed that she had a small tear in her colon and that the tear occurred during the initial procedure.

McDonald alleged that the medical staff negligently performed the initial procedure.

DEFENDANTS' CONTENTIONS: Defendants denied the allegations.

Result

The parties agreed to settle for $175,000. Further, the county agreed to pay a $40,000 Medi-Cal lien.
