Facts

On Dec. 20, 2014, at approximately 10:30 a.m., plaintiff began to walk across a residential street to reach her parked car. As she crossed the street she was struck by defendant's vehicle.

Contentions

PLAINTIFF'S CONTENTIONS: The street runs north south. She stepped off the east side curb and began walking in a northwest direction towards her car. Prior to stepping off the curb, she noticed a car stopped in an alley, facing west, on the west side of the street. The driver of this car was looking for a parking spot. He noticed a space on the west side of the street, north of the alley. He backed out of the alley and began reversing northbound. His driver's side rear bumper struck plaintiff and his driver's side rear wheel ran over plaintiff's left leg. The defendant driver then put his car in drive and ran over plaintiff's left leg again. He then parked his car.

Plaintiff claimed that defendant driver negligently failed to observe plaintiff crossing the street and ran her over, then compounded the injury by running her over again.

DEFENDANT'S CONTENTIONS: Defendant claimed that plaintiff was comparatively at fault for crossing the street in this location. She should have used a cross walk located at the next intersection.

Degloving injury to left leg from just below the knee to the ankle. Multiple surgeries to reconstruct leg, restore blood flow, skin grafts and permanent scarring with swelling of the leg with weight bearing.

Result

The case settled at mediation for $1,350,000.
