Contentions
PLAINTIFF'S CONTENTIONS: On Jan. 3, 2016, plaintiff was on the roof of Queen of the Valley Medical Center's electrical room to perform roofing repairs. Plaintiff was injured after an arc flash explosion originating from a busway system. Plaintiff sued the medical center, Blakeslee, Matrix HG and PG&E. Plaintiff sued Blakeslee for general negligence.
Plaintiff alleged that the busway system was designed by Blakeslee and argued that Blakeslee had authority to maintain the busway system, and owed him a reasonable duty of care. Mendoza further argued that Blakeslee breached its duty of care by failing to label equipment in the busway system and proximately caused his injuries.
DEFENDANTS’ CONTENTIONS: Blakeslee argued that it was not liable because it did not perform electrical work for the hospital before the explosion occurred. Further, Blakeslee argued that it did not install, own, manufacture, or maintain the busway system.
Result
Blakeslee agreed to pay Mendoza $10,000.
