William Longman sued Alicia Pena and others after he was involved in a rear-end collision.

Contentions

PLAINTIFF'S CONTENTIONS: Longman claimed that Pena negligently operated her vehicle when she rear-ended his vehicle. As a result of the collision, Longman contended, he injured his head, shoulder, and neck.

DEFENDANTS’ CONTENTIONS: Pena admitted liability but argued that Longman’s injuries resulted from prior brain traumas rather than the accident.

Damages

Longman sought past and future medical costs including $85,000 for future cervical laminectomy. Longman also sought $52,800 in lost wages and damages for pain and suffering.

Injuries

Longman contended that he suffered a traumatic brain injury, a neck injury, and a shoulder injury.

Result

The jury awarded Longman $12,129.75 in damages and found that Pena's negligence caused Longman's harm.
