Nathan and Jeniffer Eisenbise sued Crown Equipment Corp. and others, after Nathan, a Costco employee, was injured.
Contentions
PLAINTIFFS' CONTENTIONS: The plaintiffs asserted that Nathan was struck by a forklift that was manufactured by Crown and that was driven by a Costco employee. As a result, Nathan's right foot was injured. The plaintiffs argued that the forklift's defective design caused Nathan's injuries.
DEFENDANTS’ CONTENTIONS: The defendants argued that their forklift’s design was not defective and did not cause Nathan’s injuries.
Injuries
The toes on Nathan’s right foot were dislocated and crushed and the tissues in the foot were damaged. As a result, Nathan underwent multiple surgeries and ultimately amputation below his knee.
