Facts

Jamie Nault filed suit against DirecTV LLC for alleged violations under California labor law and the Fair Labor Standards Act.

Contentions

PLAINTIFF'S CONTENTIONS: Nault contended he was owed wages by the defendant.

DEFENDANT'S CONTENTIONS: DirecTV proffered several affirmative defenses to the complaint, including that Nault was not an employee for purposes of the wage laws Nault claimed were violated, nor did the Fair Labor Standards Act apply.

Result

Under a summary judgment order, the court found DirecTV was subject to the wage laws underlying the action. The parties then made a stipulation and joint motion for the court to enter judgment for Nault. The parties stipulated that Nault received wage deductions totaling $6,700, had unreimbursed business expenses in the amount of $30,000, worked hours he was unpaid for totaling $6,840, worked overtime, and was owed interest under California law for said damages. The court held Nault could recover judgment in the amount of $98,955.34.

Other Information

DirecTV is appealing the court's judgment to the Ninth Circuit Court of Appeal.
