Brian and Kimberly Bedford sued Michael Mix.

PLAINTIFF'S CONTENTIONS: The Bedfords leased a property from defendants and agreed to pay $5,500 a month in rent. Part of that sum was set aside as an allegedly refundable deposit toward potentially purchasing the property at the end of the three year lease period. The Bedfords however decided not to purchase the property when the lease period ended and the Mixes allegedly failed to return the refundable deposit, which, by the end of the lease term, was $72,000 in total. The Bedfords brought claims against defendants for breach of contract, breach of fiduciary duty, negligence, fraudulent concealment, and intentional and negligent misrepresentation.
DEFENDANTS' CONTENTIONS: Defendants claimed they did not agree to set aside a refundable deposit from the Bedford's rent.
Damages
The Bedfords sought $72,000 in damages.
Result
The Bedfords received $72,000 and prevailed on their claims for intentional misrepresentation, concealment, and breach of contract.
