Facts

Harish Uppal was on the freeway when, due to traffic ahead of him, he slowed down to adjust his driving speed. Then, a vehicle driven by defendant Antonio Garcia rear-ended Uppal's car. Uppal then drove into a wall.

Plaintiff filed suit against Garcia and his employer, defendant Advanced Environmental Compliance LLC.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff claimed Garcia was negligent in the operation of his employer's vehicle. Plaintiff claimed Garcia was in the course and scope of his employment, and therefore, Advanced Environmental Compliance was vicariously liable.

DEFENDANT'S CONTENTIONS: The defense asserted no liability. The defense also challenged the extent of Uppal's claimed injuries.

Damages

Uppal sought damages for earnings losses, medical expenses, pain and suffering, and Uppal's wife alleged loss of consortium.

Injuries

After the accident, Uppal was taken to the hospital. Uppal contended he suffered injuries to his head during the accident. Uppal also asserted he suffered from imbalance, headaches, and cognitive problems.

Result

A settlement was reached between the parties in the amount of $1 million.
