Facts

Kyoung Lee, 45, an unemployed student, sued Dependable Highway Express in relation to an automobile collision that occurred on Sept. 11, 2013, at 11:45 p.m., while on the freeway.

Contentions

PLAINTIFF'S CONTENTIONS: Lee claimed that she was injured after the automobile she was operating was struck by a vehicle that was negligently operated by Dependable Highway Express employee driver, Richard Tan. Lee contended that Dependable was vicariously liable for its employee's negligence.

DEFENDANTS' CONTENTIONS: Dependable admitted liability but contended that plaintiff's claims of injury, treatment, and ongoing claims of symptoms and disability were exaggerated, unrelated and/or nonexistent.

Settlement Discussions

Plaintiff demanded $3,000,000 before trial. Defense made a 998 offer before trial of $1,500,000.

Damages

Lee sought $11 million in damages, including lost earnings.

Injuries

Lee claimed she sustained cervical artificial disc replacement surgery and later, cervical fusion, and low back injuries. Lee also alleged debilitating psychiatric injuries, including somatic symptom disorder and severe depression and suicidal tendencies, all stemming from the accident. Plaintiff claimed she could never work again as a nurse, or in any capacity, not even part time, for the rest of her life

Result

The jury awarded Lee $1,174,000 in damages. The award included $279,000 in past medical cost, $389,000 in future medical costs, $356,000 in future lost earnings, and $75,000 in future general damages.
