Facts

Deborah Rose filed a lawsuit against Ronnie Attia relation to an automotive collision occurring on U.S. Route 101 in San Rafael.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that Attia was negligent in causing the collision because he failed to maintain control of his car and avoid the crash. Rose claimed that Attia was exiting the highway when Attia lost control of his SUV and struck the passenger side of plaintiff's car. The impact forced plaintiff to lose control of her own vehicle and caused her to hit the shoulder wall.

DEFENDANT'S CONTENTIONS: Attia disputed the claims that he was negligent. Attia claimed that the incident resulted from an emergency situation where he hydroplaned after driving over a puddle.

Settlement Discussions

Rose made a CCP 998 demand of $549,000. Attiain made a CCP 998 offer of $100,000.

Damages

Rose sought total damages in the amount of $886,621.

Injuries

Rose suffered injuries to her neck, multiple spinal disc herniations, and a fractured vertebrae. Rose received a recommendation for neck and back surgery and disc replacements.

Result

The jury rendered a verdict in favor of Attia. The jury determined that Attia was not negligent.
