Facts
On Jan. 20, 2016, Lauren Mathein and Christine Sabas, brought suit against Pier 1 Imports (U.S.) Inc. over California wage law violations.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs alleged that defendant violated California wage laws and the California Private Attorneys General Act by requiring them to plan their lives around the possibility that they would have to work every, so-called call-in shift, even though the home goods store often chose not to put them to work. The plaintiffs also accused defendant of enforcing a flex shift policy that violated California's wage order by forcing associates to report to work either by phone or in person before learning if they actually had to work that day.
DEFENDANT'S CONTENTIONS: Defendant denied the allegations.
Result
The parties entered a settlement in which defendant agreed to pay the settlement class $3.5 million with $1,116,550 to go towards paying attorney fees.
