Eduardo Nunez, a ship worker, brought suit against BAE Systems San Diego Ship Repair Inc. in connection to wage and meal break claims. Nunez represented a class of almost 2,000 other ship workers.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant violated California business laws by failing to pay employees for time spent disembarking from ships, waiting in security lines and returning tools, as well as, by causing them to miss 30-minute duty-free unpaid breaks. Plaintiff also alleged that occasionally he and others had to work at a shipbuilding facility that required them to arrive 15 minutes prior to their actual start time to swipe in, and then walk 15 minutes to their site for the day, all of which was unpaid.
DEFENDANT'S CONTENTIONS: Defendant denied the allegations.
Result
The parties entered a settlement in which the defendant agreed to pay the settlement class $2.9 million.
