Patricia Tillotson filed suit against The Home Depot in relation to allegations of wrongful termination and retaliation.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff claimed wrongful termination based on her age and disability, and in retaliation for making workplace complaints. Plaintiff also alleged that Home Depot failed to provide reasonable accommodations for disabilities related to breast cancer and varicose veins. Plaintiff contended that defendant failed to provide her with reasonable accommodations for her disability due to breast cancer reconstructive surgery and varicose veins. Plaintiff further alleged that defendant failed to shield her from retaliation after she reported violations in the store in which she worked. Plaintiff further alleged that defendant wrongfully terminated her employment because of her age, disabilities, and whistleblowing.

DEFENDANT'S CONTENTIONS: Defendant argued that plaintiff was one of six employees fired after an investigation determined that the employees were violating Home Depot policies by giving unauthorized price reductions to a customer in exchange for gifts.

Damages

Plaintiff sought $3.3 million in damages.

Result

The jury found in favor of plaintiff and awarded her $175,500, which included $75,000 in past economic damages and $100,000 in future economic damages. The jury unanimously found in favor of defendant as to all other claims, including wrongful termination.
