Lilit Barsegyan filed an arbitration claim against Arin Torabian in relation to a dispute over commissions.

Contentions

CLAIMANT'S CONTENTIONS: Claimant alleged that a logistical error resulted in respondent receiving a share of claimant's commissions. Claimant asserted causes of action for breach of contract, unjust enrichment, and conversion.

RESPONDENT'S CONTENTIONS: Respondent denied all of claimant's allegations and asserted various affirmative defenses.

Damages

Claimant sought $100,000 in compensatory damages, reimbursement of all forum fees and costs, interest at the legal rate on all sums recover, and attorney fees and costs.

Result

The arbitrator found that respondent was unjustly enriched by $40,000 to the detriment of claimant and determined that respondent should pay claimant $40,000 in compensatory damages, $7,519.63 in pre-judgment interest, and $225 to reimburse a non-refundable portion of the filing fee.
