CLAIMANT'S CONTENTIONS: Claimant asserted causes of action for breach of contract, fraud, misleading statements, and misleading omissions of material information, breach of fiduciary duty, negligent misrepresentation, negligence, breach of contract and warrant and third party beneficiary breach of contract, breach of the covenant of good faith and fair dealing, and failure to supervise.

RESPONDENTS' CONTENTIONS: Respondents denied the allegations and asserted various affirmative defenses.

Damages

Claimant sought general, special and compensatory damages, statutory damages, and attorney fees and cost.

Result

The panel granted the respondents' motion to dismiss claimant's claims with prejudice, finding that his claims are barred pursuant to Rule 12504 and 12209 of the Rule Code.
