Facts

Plaintiff filed a lawsuit against Infinite Innovations in relation to its alligator clip covers.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that Uriah Products LLC manufactures, imports, sells and/or distributes for sale in California alligator clip covers that contain di(2-ethylhexyl)phthalate (DEHP) without providing adequate warnings under Proposition 65. DEHP is a chemical known to the State of California to cause birth defects and reproductive harm.

DEFENDANTS' CONTENTIONS: Defendants denied plaintiff's allegations and contended that its products were in compliance with the law.

Result

The parties reached a settlement agreement in the amount of $29,500. Defendant also agreed to manufacture for sale reformulated products or provide clear and reasonable warnings under Proposition 65.
