PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant erred in finding that he was not disabled within the meaning of his insurance plan.
DEFENDANT'S CONTENTIONS: Defendant contended that the medical evidence did not support the finding that plaintiff would be precluded from performing the material and substantial duties of his occupation as a tax director, and that plaintiff was not totally disabled within the meaning of his insurance plan.
Result
The court found in favor of the plaintiff, finding that he established by a preponderance of the evidence that he was disabled under the terms of his insurance plan during the relevant period and that defendant erred in denying his disability benefits.
