Facts

Mark Stanley-Bey filed a civil rights action pursuant to 42 U.S.C. Section 1983 against San Quentin State Prison in relation to Americans with Disabilities Act violations.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that he was knocked unconscious when he fell in his cell and thereafter suffered various head and lower limb issues. Plaintiff claimed he requested to be assigned to a lower bunk and wanted to be excused from work, but that it took 165 days for the request to be granted, during which time he endured pain and suffering.

DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff failed to state a claim upon which relief could be granted.

Result

The court granted defendant's motion to dismiss for failure to state a claim upon which relief can be granted.
