Facts

On March 20, 2017, Lucille Sullivan brought suit against the City and County of San Francisco, San Francisco Unified School District in relation to Sullivan tripping and falling on a sidewalk located in the City and County of San Francisco.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant is liable for her damages due to the dangerous conditions of the sidewalk. Plaintiff further alleged that the sidewalk was dangerous and defective because it was uneven.

DEFENDANTS' CONTENTIONS: Defendants denied the allegations and asserted the affirmative defenses of, failure to state a claim, failure to comply with government code, statute of limitation, public liability act, immunity, assumption of risk, comparative negligence, contribution, barred by Government Claims Act, design immunity, and no ownership or control.

Damages

Plaintiff requested general damages, special damages, and costs of suit.

Result

The parties agreed to a settlement in which defendants agreed to pay plaintiff $40,000.
