Facts

On Nov. 9, 2016, at 2:30 p.m., plaintiff Seo Young Lee was traveling eastbound on James M. Wood Blvd., while defendant Song Pok Kwak was traveling westbound. Plaintiff was crossing in a crosswalk when defendant made a left turn from Vermont and struck plaintiff.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended defendant was negligent in the operation of her vehicle. As a result, plaintiff suffered injuries.

DEFENDANT'S CONTENTIONS: Defendant did not dispute liability.

Plaintiff demanded $250,000 policy limits. Defendant offered $90,000 prior to acceptance of policy limits demand of $250,000.

Injuries

Plaintiff had a mild traumatic brain injury, a herniated disc in his lower back that required epidural injections, a left tibial fracture, and a meniscus tear, resulting in severe left knee/leg pain. Plaintiff was unable to walk because of the severity of the pain. Plaintiff struck his head as a result of the impact which resulted in a mild traumatic brain injury. Since the collision plaintiff has been confused and disoriented, even more than he previously was. Although plaintiff had a pre-existing condition of Alzheimer's, after the collision he was no longer able to care for himself and he had to move into a skilled nursing facility for almost three months. Plaintiff was hospitalized at St. Vincent Medical Center for four days. He was then transferred to Hollywood Presbyterian Medical Center, where he was hospitalized for another 10 days after discharge from Hollywood Presbyterian Medical Center he was transferred to a skilled nursing facility, Grand Park Convalescent Facility, where he had to remain for almost three months.

Result

The case settled for $250,000.
