Facts
A class of direct buyers filed a class action against multiple electronic component manufacturers, including Japanese based Nichicon Corp. and Rubycon Inc., in relation to claims of price-fixing.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiffs alleged that Nichicon and Rubycon colluded with other manufacturers in an attempt to raise the prices of electronic capacitors. Plaintiffs argued that the price-fixing scheme took place for over 10 years.
DEFENDANT'S CONTENTIONS: Defendants denied the allegations.
Result
The case settled for a total award $108 million. The settlement agreement requires Nichicon to pay $90 million. Rubycon is required to cover the remaining $18 million and an additional $12 million contingency. An estimated $30 million of the award is slated for attorney fees and costs.
