Facts

Gerald Carlin filed a putative class action against DairyAmerica Inc. and its affiliate California Dairies in relation to milk prices paid to farmers.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that DairyAmerica misreported dairy product prices to the U.S. Department of Agriculture's National Agriculture Statistics Service to lower the price its members had to pay for nonfat dairy milk. Plaintiffs claimed that DairyAmerica did this to maximize the profits of its nine member cooperatives.

DEFENDANTS' CONTENTIONS: Defendants denied the contentions.

Result

The parties reached a settlement agreement in which DairyAmerica agreed to pay $40 million.
