Plaintiff filed suit against Maped Helix USA Inc. in relation to the sale of cutting mats.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant sold cutting mats that contained DEHP without providing the health hazard warning that is required by Proposition 65.

DEFENDANT'S CONTENTIONS: Defendant denied all allegations and asserted various affirmative defenses.

Result

The parties entered into a Consent Judgment, in which defendant agreed not to sell any of their cutting mats in California, unless the bags contain less than 1,000 parts per million of DEHP or have a Proposition 65 warning. Defendant will also pay $1,000 in civil penalties, with 75 percent paid to the California Office of Health Hazard Assessment and the remaining 25 percent paid to plaintiff. Additionally, defendant will reimburse plaintiff $23,000 for his attorney fees and costs.
