William Hearn filed suit in regards to cataract surgery performed by defendant Dr. Janangir Sadeghi.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff, a prisoner, contended that the day after he had cataract surgery he began suffering severe and constant headaches and blurred vision. Plaintiff claimed that after defendant saw him multiple times he finally recommended him to a specialist. Plaintiff alleged that defendant misdiagnosed him and his actions amounted to deliberate indifference to serious medical needs under the Eighth Amendment.
DEFENDANT'S CONTENTIONS: Defendant contended that plaintiff failed to exhaust all available administrative remedies. Defendant also argued that he is entitled to summary judgment because there was no disputed material fact that he acted with deliberate indifference.
Result
The court granted defendant's motion for summary judgment finding that defendant showed that there was no genuine issue of material fact with respect to plaintiff's deliberate indifference claim, and also that the claim is dismissed because plaintiff failed to exhaust all administrative remedies.
